1. About the Services

Bizzkat provides cloud-based software tools and related services for businesses, including but not limited to:

• Point-of-sale (POS) software
• Customer ordering applications
• Order management tools
• Analytics and reporting
• Business automation features
• Integrations with third-party services
• Payment-related integrations

The Services are intended for business and commercial use.

2. Eligibility

You may use the Services only if:

• You are at least 18 years old;
• You have the legal authority to enter into these Terms;
• You are using the Services on behalf of a valid business or organization; and
• Your use of the Services complies with applicable laws and regulations.

If you use the Services on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

Bizzkat does not act as the merchant of record unless explicitly stated otherwise.

• Pay all applicable subscription fees, usage fees, transaction fees, or other charges;
• Provide valid payment information;
• Authorize recurring charges where applicable.

Fees are generally non-refundable unless required by law.

We may change pricing at any time with reasonable notice.

Failure to pay may result in suspension or termination of the Services.

Third-party payment processors may process payments on our behalf. Your use of such services may also be subject to their own terms and privacy policies.

7. Third-Party Services

We are not responsible for:

10. Customer Content

You retain ownership of the content and data you submit to the Services (“Customer Content”).

You grant Bizzkat a worldwide, non-exclusive license to host, process, transmit, and use Customer Content solely for:

• Providing and maintaining the Services;
• Security and fraud prevention;
• Analytics and system improvement;
• Legal compliance.

You represent that your Customer Content does not violate any laws or third-party rights.

11. Service Availability

We strive to maintain reliable Services but do not guarantee uninterrupted or error-free operation. As we're a startup, services may be disrupted as we continue to refine features.

The Services may be temporarily unavailable due to:

• Maintenance;
• Updates;
• Network issues;
• Third-party outages;
• Circumstances beyond our control.

We may modify, suspend, or discontinue parts of the Services at any time.

12. Features

All of our features are currently in beta as we strive to improve and refine every single feature we offer.

These features:

• May contain bugs or errors;
• May change or be removed at any time;
• Are provided “as is” without warranties.

13. Suspension and Termination

We may suspend or terminate your access immediately if:

• You violate these Terms;
• Required payments are overdue;
• Your activities create legal or security risks;
• We are required to do so by law.

You may stop using the Services at any time.

Upon termination, your access may be disabled, certain data may be deleted after a retention period, and outstanding fees remain payable.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

BIZZKAT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING:

• MERCHANTABILITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• NON-INFRINGEMENT;
• ACCURACY OR RELIABILITY.

We do not guarantee that the Services will be uninterrupted or error-free, meet your specific requirements, or that data loss will never occur.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZZKAT SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, goodwill, or data;
• Business interruption;
• Third-party claims.

Bizzkat shall not bear responsibility for any damages or legal actions that emerge in the event of your non-compliance with the law, violation of this agreement, or infringement upon the rights of any third party.

The provision of our Service is offered on an "as is" and "as available" basis.

Through your utilization of our Service, you agree to indemnify and hold Bizzkat harmless from any claims, losses, liabilities, or damages arising due to your actions, breaches of this agreement, or any harm inflicted on third parties.

16. Indemnification

You agree to indemnify and hold harmless Bizzkat and its officers, directors, employees, and affiliates from claims, liabilities, damages, and expenses arising from:

• Your use of the Services;
• Your violation of these Terms;
• Your violation of laws or third-party rights;
• Your products, services, or business operations.

17. Governing Law

These Terms are governed by the laws of Singapore.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

18. Changes to the Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice through the Services, email, or other reasonable methods.

Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
